الآليات غير قضائية لتسوية منازعات الصفقات العمومية

Résumé: لقد وضع المشرع الجزائري عدة أساليب بديلة عن القضاء بقصد التوصل إلى حل للنزاعات التي قد تنشا عن الصفقات العمومية بشكل سريع وبسيط نسبيا مقارنة بالقضاء الذي يتطلب إجراءات طويلة وصارمة أحيانا، وبشكل يضمن حقوق الأطراف مما يحقق استمرار العلاقة الودية بينهم، حيث اعتمد المشرع الجزائري إمكانية تسوية هذه النزاعات من خلال التسوية الودية عن طريق لجان التسوية، وعن طريق إمكانية اللجوء الى التحكيم. The Algerian legislator has developed several alternative methods for the judiciary in order to reach a solution to the disputes that may arise from public deals in a relatively quick and simple way compared to the judiciary, which requires long and sometimes strict procedures and in a way that guarantees the rights of the parties, thus achieving the continuation of the friendly relationship between them, as the Algerian legislator adopted the possibility of settling these settlement committees, and through the possibility of resorting to arbitration.
