الحماية القانونية للمسير من تعسف جهاز إدارة شركة المساهمة في ظل علاقات العمل

Résumé: ملخص: يتناول هذا المقال حماية المسير من التعسف في استعمال حق جهاز إدارة الشركة في حالة الفصل التعسفي في قانون علاقات العمل والمرسوم التنفيذي رقم 90–290 المتعلق بالنظام الخاص بعلاقة العمل مسيري المؤسسة، بالتركيز على مفهوم التعسف في استعمال الحق، ثم حالات تعسف جهاز إدارة الشركة التي يلجأ إليها كإجراء تعسفي في حق المسير من أجل تسريحه، هذا الحق وضع عليه المشرع الجزائري قيودا إجرائية وموضوعية متى تم مخالفتها كان كل إجراء متخذ ضد المسير باطلا يتحمل المستخدم المسؤولية عنه. وهذا حماية لاستقرار علاقة العمل وتحقيق التوازن بين طرفي علاقة العمل والامتثال لما تضمنه عقد العمل باعتباره الإطار القانوني لهذه العلاقة. This article deals with the protection of the manager against the abuse of the right of the management of the company set up in unfair dismissal under the law on labor relations and Executive Decree No. 90-290 relating to the employment relationship system of company directors, focusing on notion of abuse of rights. Then there are cases of abuse on the part of the management of the company, which the body of the institution uses as an arbitrary measure against the right of the leader to release him. This right that the Algerian legislator has imposed procedural and objective restrictions: each time they are violated, any measure taken against the manager is null and the user assumes responsibility for them.
