الضمانات الدستورية المكفولة أثناء عملية تنظيم حرية البحث العلمي في كل من: الجزائر – مصر– تونس-سويسرا

Résumé: يحمي الدستور الحقوق والحريات من خلال إضفاء عليها المكانة السامية التي يتمتع بها، والتي تفرض وجوب الامتثال وتكيف التشريعات الأخرى في الدولة مع أحكامه ، لا سيما أثناء عملية تنظيم هذه الحقوق والحريات، فالدستور فوق الجميع، وهو القانون الأساسي‮ ‬الذي‮ ‬يضمن الحقوق والحريات الفردية والجماعية(1)، و تعتبر حرية البحث العلمي إحدى هذه الحريات والتي نصت عليها دساتير عدة دول من بينها: التعديل الدستوري الجزائري لسنة 2016 ، والدستور المصري، و الدستور التونسي، والدستور السويسري. Abstract: The Constitution protects the rights and freedoms by granting them the high status that it enjoys, which imposes the obligation to respect and adapt other laws in the state to its provisions, especially during the process of regulating these rights and freedoms. The Constitution is above all the fundamental law guaranteeing individual and collective rights and freedoms. And freedom of scientific research is one of these freedoms stipulated in the constitutions of several countries, including: the Algerian constitutional amendment of 2016, the Egyptian constitution, the Tunisian constitution and the Swiss constitution.
