القاعدة الشرعية "تزاحم المفاسد": حقيقتها- حكمها- وتطبيقاتها

Résumé: ملخص: من أهم القواعد التي تضبط التعارض بين الأضرار و المفاسد قاعدة: " إذا تعارض مفسدتان روعي أعظمهما ضررا بارتكاب أخفهما ". و قد أَوْلى لها من صنّف من العلماء في القواعد الفقهية أهمّية كبرى، فأوردها أغلبهم في مصنفاتهم، و ذكروا لها أمثلة فقهية تطبيقية تبين معناها و توضحه، و علل بها الفقهاء في كثير من الأحكام الفقهية. و قد قمت بهذه الدراسة النظرية و التطبيقية للقاعدة. Abstract: One of the most important rules that govern the conflict between damage and evil is the rule: "If two corrupts are concerned, the greatest of them is the harm of committing the lesser of them." And has given them a class of scholars in the rules of jurisprudence of great importance, most of them cited in their work, and they have examples of applied jurisprudence that shows its meaning and explain, and explained by scholars in many jurisprudential judgments. I have done this theoretical and applied study of the base.
