من أنسنة الأخلاق إلى أنسنة العقد الطبيعي عند ميشال سير Michel Serres: From Humanizing Morals To Humanizing The Natural Contract

Résumé: يقدم لنا الفيلسوف الفرنسي ميشال سير نظرية مكملة لنظرية العقد الاجتماعي أو بعبارة أخرى عقد اجتماعي جديد يقوم على أسس واضحة، فبعد أن كان العقد الاجتماعي مخصص بين الأشخاص، صار العقد الطبيعي يجمعهم بكوكبهم. فالعقد الطبيعي هو ربط العقد الاجتماعي بالعقد القانوني. قام ميشال سير على تحرير العقد من كل فرض غير أخلاقي لا يتوافق مع أخلاق البيئة، أي عمل على تحويل العلاقة التطفلية المفترسة إلى شريك تكافلي لتبادل عادل نقدم للطبيعة مثلما تعطينا. وذلك من خلال ربطه العقد الاجتماعي بالعقد القانوني وجعل الطبيعة موضوع حق. وإنشاء مجتمعات إنسانية متساوية ومتعادلة، تقوم على أساس الحب والتكافل. إن فكرة أن تكون الطبيعة موضوع حق، كما يراها وميشال سير، تثير صعوبات، في تبرير أن الطبيعة وكائناتها تفتقر لشروط التعاقد وإمتلاك الحق لعدم امتلاكهم، العقل والإرادة واللغة، ليبقى العقد الطبيعي في حدود المجاز. كلمات مفتاحية: التكافل، الطفيلي، العقد الإجتماعي، العقد الطبيعي، العلم، القانون Abstract: The French philosopher Michel Serres offered a theory that complemented the theory of the social contract. In other words, Serres offered a new social contract based on clear foundations. After the social contract was reserved for people, the natural contract now brings them together with their planet. The natural contract is the linking of the social contract to the legal contract. Serres freed the contract from every immoral imposition that is not compatible with the ethics of the environment. Thus, Serres transformed the parasitic predatory relationship into a symbiotic partner for a fair exchange through which we offer to nature. This is done by linking the social contract to the legal contract and making nature an object of right and by establishing equal human societies, based on love and solidarity. The idea that nature is the subject of right, as Michel Serres sees, raises difficulties in justifying that nature and components of environment lack the conditions for contracting and possessing the right because they do not possess reason, will, and language.
