الصّناديق الوقفية كآلية لتفعيل الدّور التّنموي للوقف وتحقيق الأمن الاجتماعي (قراءة قانونية في التّجربتين الجزائرية والكويتية)

Résumé: ملخص : يتناول هذا المقال دراسة الصناديق الوقفية، حيث نهدف من خلاله إلى إبراز دورها في تفعيل الدور التنموي للوقف وتحقيق الأمن الاجتماعي للدولة،مع تسليط الضوء على التجربتين الكويتية التي تعد رائدة في هذا المجال وكذا الجزائرية، وذلك من خلال محاولتنا الإجابة على إشكالية تتمحور حول الدور الذي يمكن أن تسهم به هذه الصناديق في تنمية الأوقاف وتفعيل دورها التنموي لتحقيق الأمن الاجتماعي،منتهجين في ذلك كلا من المنهجين الوصفي والتحليلي وكذا المقارن. هذا وقد خرجنا من خلاله بمجموعة من النتائج أبرزها: أن الصناديق الوقفية بالصيغة الكويتية هي الأحسن لاستثمار وتنمية الأملاك الوقفية ودعم دورها التنموي، ضم مداخيل الأملاك الوقفية في صندوق وقفي مركزي واحد كما هو معتمد في الجزائر يثير عدة إشكالات وتناقضات خاصة من الناحية القانونية. Abstract: This article deals with the endowment funds study, through which we aim to highlight its role in activating the developmental role of the endowment and achieving social security for the country as a whole, while highlighting the two Kuwaiti experiences that are pioneering in this field as well as trying to answer a problem in which it revolves around the role that these funds can play in the framework of the endowment development and activating its developmental role to achieve social security, taking both the descriptive and analytical approach as well as the comparator. and we have come out through this study of a group Among the results that we mentioned at the end of the research, the most prominent of which is that the endowment funds in the Kuwaiti formula are the best way to invest and develop endowment properties and support their development role, including the income of endowment properties in one central endowment fund as approved in Algeria raises several problems and contradictions from the legal point of view.
