الهندسة القانونية لمهنة الوكيل المعتمد لدى الجمارك في التشريع الجمركي الجزائري

Résumé: الملخص: تؤدي الإدارة الجمركية وظائفا ومهاما استراتيجية مكَّنها منها قانون الجمارك، تهدف إلى حماية الاقتصاد الوطني و تحقيق المصلحة العامة من خلال إحكام الرقابة المادية والمالية على حركة البضائع والأشخاص من و إلى البلاد. باعتماد إجراءات جمركية لاسيما تلك المتعلقة بجمركة البضائع في إطار التّبادلات التجارية الدّولية. التي تعرف نوعا من التّعقيد خاصة تلك المرتبطة بالتصريح المفصّل في مختلف مراحله، أين يلتزم المتعامل الاقتصادي بإنجازها والوفاء بها. ونظرا لإرتباطها بالسرعة وكفاءة القائم بها أجاز المشرع الجمركي منح إعتماد جمركي خص به الأشخاص المؤهلون لإدارتها و تسييرها باعتبارها مهنة، أين أقرته المادة 78 من قانون رقم 79-07 المؤرخ في21 يوليو سنة 1997 والمتضمن قانون الجمارك، المعدل والمتمم، ونظمها المرسوم التنفيذي رقم 10-288 المؤرخ في 14 نوفمبر2010، يتعلق بالأشخاص المؤهلين بالتصريح المفصل للبضائع. وحدّد من خلالها الإطار التنظيمي والعملي والإجرائي الذي يتدخل به الوكيل المعتمد لدى الجمارك لمزاولة مهنته بهذه الصفة وتبيان آثارها. الكلمات المفتاحية: الإجراءات الجمركية، المهنة، الوكيل المعتمد لدى الجمارك، التصريح المفصل، المتعامل الاقتصادي. Abstract: The Customs Administration carries out strategic functions and tasks permitted by the Customs Law, aimed at protecting the national economy and achieving the public interest by strengthening physical and financial control over the movement of goods and people to and from the country. By adopting customs regimes, especially those related to the customs of goods in the framework of international trade. Which is characterized by a kind of complexity, especially that related to the detailed declaration in its different stages, where the economic trader is obliged to complete and fill it out. Given its link with the speed and efficiency of those responsible, the customs legislator has allowed the granting of customs approval to persons qualified to manage and exercise it professionally, as authorized by Article 78 of Law No. 79-07 of July 21, 1997, which includes the Customs Law, amended and supplemented, and regulated by Executive Decree No. 10-288 of November 14, 2010 relating to eligible persons. With the detailed declaration of goods. Through it, it has defined the regulatory, practical and procedural framework through which the customs broker intervenes to exercise his profession and explained its effects.
