الطرق القانونية والتكنولوجية للحد من انتهاك الأمانة العلمية كوسيلة للتلاقى المعرفي بين القانون والعلوم الأخرى Legal And Technological Ways To Limit The Violation Of Scientific Integrity As A Means Of Knowledge Convergence Between Law And Other Sciences

Résumé: تعتمد كل العلوم بجل تخصصاته المعرفية على البحث العلمي، ومن أهم وسائله عدم انتهاك الأمانة العلمية، حيث تعد هاته الأخيرة نقطة تلاقي معرفي بين العلوم خصوصا العلوم القانونية بغيرها من العلوم. فانتهاك ميثاق الأمانة العلمية يعد خرقا أكاديميا خطيرا، وذلك من خلال الاستخدام غير المعترف به لأفكار وأعمال الآخرين والذي يحدث بقصد أو بغير قصد والذي يعرف بالسرقة العلمية. لذا يجب أن تسعى المؤسسات العلمية والأوساط الأكاديمية للقضاء على هاته الظاهرة المضرة بالبحث العلمي. وأن يعمل القانوني من جهته على الحد من هذا الانتهاك ومجابهته بكل الأساليب المتاحة القانونية على المستوى الدولي أو الوطني على أن يكون لمهمته هذه تأثيرا على التكنولوجي الذي يعمل على تخصيص طرق تكنولوجية مجانية أو مدفوعة تعد خط ردع لمعتدى السرقة العلمية. All sciences, in most of their cognitive disciplines, depend on scientific research, and one of the most important means is not violating the scientific honesty, as the latter is a point of convergence of knowledge between sciences, especially legal sciences with other sciences. Violation of the Charter of Scientific Honesty is a serious academic breach, through the unacknowledged use of the ideas and actions of others, which occurs intentionally or unintentionally, which is known as scientific theft. Therefore, scientific institutions and academia should strive to eradicate this phenomenon that is harmful to scientific research. And that the legal person, on his part, works to limit this violation and confront it with all available legal methods at the international or national level, provided that his mission has an impact on the technology that works to allocate free or paid technological methods that are a line of deterrence for the aggressor of scientific theft.
