تفعيل سلطات الضبط الاقتصادي للمنافسة في مجال الصفقات العمومية

Résumé: ملخص: تعتبر الصفقات العمومية من العقود الادارية التي كفلها المشرع الجزائري بنظام قانوني خاص، وعمل على تكريس مبدأ حرية المنافسة بين المتعهدين في مختلف مراحل ابرامها واجراءاتها، كما أخضعها لأحكام قانون المنافسة 03/03 إثر تعديله بالقانون 08/12، بدء من نشر الاعلان عن المناقصة الى غاية المنح النهائي للصفقة، باعتبارها من المجالات الملائمة لانعقاد الاتفاقات المقيدة للمنافسة، وعليه تثار مسألة اختصاص مجلس المنافسة بضبط هذه الممارسات وفقا لأحكام قانون المنافسة، اضافة الى اختصاصات سلطة ضبط الصفقات العمومية المنشأة بموجب المرسوم الرئاسي رقم 15/247 المتعلق بالصفقات العمومية سعيا لتفعيل المنافسة في اطار التعاقد في مجال الصفقات العمومية. Abstract: Public transactions are considered to be administrative contracts which has been secured by the Algerian legislator with a special legal system. They have been Devoted to the principle of freedom of concurrence among the contractors at various stages of their conclusion and procedures ;and Submit it to the Provisions of the concurrence law 03/03. Following its amendment by the law 08/12, From the publication of the announcement of the tender to the final grant of the transaction, Therefore; an issue raised specialty of the concurrence Council to regulate such practices in accordance to the provisions of a concurrence Law, in addition to the regulatory Authority of public transactions. established by Presidential Decree No. 15/247, on public transactions to activate the free concurrence in the Framework for contracting in the field of public transactions
