الأعراف المخالفة لأحكام الزواج وانحلاله شرعا وقانونا في المجتمع الجزائري

Résumé: العرف هو عادة جمهور قوم من قول أو فعل، ويشترط لصحة العمل به أن يكون مطردا ولا يتضمن مخالفة لنص شرعي أو يعطل مصلحة شرعية، وله دور كبير في معاملات الناس وعلاقاتهم خصوصا ما تعلق بالأحوال الشخصية من زواج وطلاق ومورايث. وقد ابتلي الناس بعادات وتقاليد جعلوا لها مرتبة العرف والتزموا بها في حياتهم على ما فيها من مخالفة للشرع والقانون نصا وروحا ومقصدا في كثير من المسائل المتعلقة بالزواج وانحلاله تم عرضها في هذا البحث Custom is usually for an audience of people. Is required to be valid: the continuity; Not violate a legal text or legitimate interest. It has a big role in people's dealings an relations especially in matters of personal status of marriage, divorce and inheritance. And the people was blighted by mores and traditions, they made it in the order of custom and stick to them in their lives despite their violation of Sharia and law in ther Texts, spirits and purposes in many matters of marriage and its dissolution that were explained in this research.
