الهيئات الاستشارية للإدارة العمومية (دراسة في مدى فعالية الهيئات الاستشارية الوطنية في القانون الجزائري)

Résumé: تساهم هذه الورقة البحثية في دراسة مفهوم الهيئات الاستشارية للإدارة العمومية ونظامها القانوني، ورغم تضخّم هذه الهيئات في النظام القانوني الجزائري واختلاف أعمالها، فقد حاول الباحث تقصّي أهمّ الهيئات الاستشارية الوطنية، سواء حازت مكانة دستورية أو تشريعية أو تنظيمية، وتسجيل بعض الملاحظات حول تنظيم وواقع هذه الهيئات، وتصنيفها ومدى نجاعة أدائها والسلبيات المسجّلة بهذا الشأن، وفحص دورها الاستشاري من خلال مختلف أعمالها (آراء، اقتراحات، توصيات، تقارير ...) ومدى تأثيرها في صناعة القرار، ليخلص في الأخير إلى بعض النتائج واقتراح بعض التوصيات. This research contributes to the study of the concept and juridical regime of consultative bodies of the public administration. Despite the inflation of these bodies in the Algerian juridical system and the difference in their works, the researcher tried to explore on the most important national consultative bodies, if they have a constitutional, legislative or regulatory status, and to register some observations on the organisation and the reality of these bodies, their classification and the efficiency of their performance and the negative points observed in this respect, and to examine their consultative role through their different works (opinions, proposals, recommendations, reports...) and the extent of their impact on the decision-making, to conclude finally some conclusions and propose some recommendations.
