تجديد علم أصول الفقه وعلاقته بالقياس الفقهي: دراسة معرفية منهجية نقدية في موقفي حسن الترابي ومحمود الطحان Renewing The Science Of The Principles Of Jurisprudence And Its Relationship To Jurisprudential Analogy: A Systematic Critical Cognitive Study In The Positions Of Hassan Al-turabi And Mahmoud Al-tahhan

Résumé: يأتي اختيار موضوع هذه المساهمة العلمية في سياق معرفي وتاريخي خاص، سمتُه الغالبة النقاشُ العلمي الحاد حول تجديد الدين الإسلامي بشكل عام، وتجديد العلوم الإسلامية بشكل خاص، وتجديد علم أصول الفقه بوجه أخص. ففي سنة 1980م، تمخض رحم الفكر الإسلامي بولادة قيصرية شقت إجماعه، بخروج مولود جديد إلى هذا الكون المعرفي الإسلامي، لكنه لا كباقي الولادات، في صورة صرخة مدوية للآفاق، أطلقها حسن الترابي، من خلال ادعائه قصور القياس المبني على العلة، وترشيحه القياس المبني على المصلحة، لفتح آفاق استنباطية واسعة للفقه الإسلامي. ومنذ ذلك الوقت، سالت أقلام الفكر الإسلامي المعاصر في تحليل دعوى الترابي هذه، بين مؤيد ومعارض لها؛ ويعد محمود الطحان من القسم المعارض لهذه التصورات التجديدية. وهذه الدراسة تهدف عرض الأسس العلمية والمنهجية الموجهة لموقف كل من الترابي والطحان، من أجل الوصول إلى تحليل نقدي لكلا التصورين السابقين، بغية محاولة الإجابة عن سؤال تجديد علم أصول الفقه، في علاقته بتوسيع قدرات القياس ليشمل المؤسس على الحكمة. The selection of the topic of this scientific contribution comes in a special historical and epistemological context, characterized by the sharp scientific debate on the renewal of the Islamic religion in general, the renewal of Islamic sciences in particular, and the renewal of the science of jurisprudence in particular. In the year 1980 AD, the womb of Islamic thought gave birth to a caesarean section that broke its consensus, with the emergence of a new born into this Islamic knowledge universe, but it is not like other births, in the form of a resounding cry for the horizons, launched by Hassan al-Turabi, through his claim of the deficiency of measurement based on the cause, and his nomination of the analogy based on the interest, to open broad prospects for deductive Islamic jurisprudence. Since that time, the pens of contemporary Islamic thought have asked about the analysis of Al-Turabi's claim, between supporters and opponents of it; Mahmoud al-Tahan is one of the section opposed to these innovative perceptions. This study aims to present the scientific and methodological foundations guiding the position of each of Al-Turabi Al-Tahhan, in order to reach a critical analysis of both previous scenarios, in order to try to answer the question of renewing the science of jurisprudence, in relation to expanding the capabilities of analogy to include the founder on wisdom.
