دور الهيئات المحلية في حماية البيئة

Résumé: من المعلوم أن موضوع حماية البيئة أصبح يلقي اهتماما كبيرا على المستوى العالمي المحلي، نظرا للتدهور الكبير والخطير الذي أصبحت تتعرض له، الأمر الذي دفع بالمشرع إلى سن العديد من التشريعات التي تهدف إلى توزيع مختلف الصلاحيات على مختلف الأجهزة والهيئات التي من شأنها أن تلعب دور في مجال المحافظة على البيئة. فحماية البيئة ترتبط ارتباطا وثيقا بالتنمية المستدامة, الأمر الذي دفع بالمشرع إلى المبادرة بالعديد من الخطوات لتوفير الحماية للبيئة، وأبرزها إسناد مهمة حماية البيئة للولاية والبلدية ، ذلك لدورهما المهم في حماية البيئة وذلك بحكم قربهما من المواطن وكذا مناطق البيئية لأن مقتضيات التلوث غالبا ما تتطلب سرعة التدخل في الوقت المناسب قبل انتشار التلوث إلى مناطق أكبر ومن أجل قيام الولاية والبلدية بهذا الدور منحهما المشرع العديد من الصلاحيات والآليات للحفاظ على البيئة وترقيتها ،إلا أن هذا الدور يبدو متواضع بالنظر لتزايد وارتفاع نسبة التلوث، ذلك ويرجع هذا لتهاون الهيئات المحلية في مجال حماية البيئة بتغاضيها عن كثير من المخالفات وكذا نقص في الموارد المالية لبعض الهيئات المكلفة بهذه المهمة. الكلمات المفتاحية: الهيئات المحلية، حماية البيئة، الولاية، البلدية، التلوث. abstract: It is known that the issue of environmental protection has become receiving great attention at the local global level, given the great and dangerous deterioration to which it has become, which prompted the legislator to enact many legislations aimed at distributing various powers to the various agencies and bodies that would play a role in field of environmental conservation. The protection of the environment is closely related to sustainable development, which prompted the legislator to initiate many steps to provide protection for the environment, most notably assigning the task of protecting the environment to the state and the municipality, due to their important role in protecting the environment, due to their proximity to the citizen as well as the environmental areas because the requirements of pollution often require The speed of intervention in a timely manner before pollution spreads to larger areas, and in order for the state and municipality to play this role, the legislator granted them many powers and mechanisms to preserve and promote the environment. The environment condones many violations, as well as a lack of financial resources for some bodies entrusted with this task.
