عن إشكالية إنتقال التركة الرقمية بعد الوفاة

Résumé: أضحت الأموال الموروثة في عصر التكنولوجيات الحديثة تتخذ شكلا جديد ونوع خاص من التركات التي باتت تدعى "التركة الرقمية " كالصور والقصائد والفيديو والمقاطع الصوتية وغيرها، والأشياء الرقمية التي تتضمن قيم عاطفية شائعة جدا وتتمثل في الغالب في حسابات التواصل الاجتماعي مثل الفيسبوك والتويتر والبريد الالكتروني، لذا تسعى الدراسة لبيان أهم المصالح التي يمكن للشخص المتوفي أن يتركها لورثته التي تمثل المصلحة الاقتصادية كما إذا كان محل تجاري أو حساب أو اشتراك مالي أو إيرادات إعلانية تعود للمتوفى من موقع ويب أو يوتيوب حيث تكون فيه شخصية المتوفي أو اسم عائلته محل اعتبار فيه مما يتطلب ضرورة انتقاله للورثة وعدم إمكان بيعه أو تقويمه بالنقود ،لكن هذا الإنتقال أثار جدلا فقهيا وقانونيا في التشريعات المقارنة مع غياب أحكام خاصة بالتنشريع الجزائري. الكلمات المفتاحية:التركة الرقمية،أصول رقمية،مواقع التواصل الإجتماعي،التكنولوجيات الحديثة. Abstract: The money inherited in the era of modern technologies is taking a new form and a special type of legacy that has been called “digital legacy” such as photos, poems, videos, audio clips, etc., and digital things that include emotional values are very common and are mostly represented in social networking accounts such as Facebook, Twitter and e-mail, so The study seeks to show the most important interests that the deceased person can leave to his heirs, which represent the economic interest, such as whether it is a commercial store, an account, a financial subscription, orAdvertising revenue belonging to the deceased from a website or YouTube, where the personality of the deceased or his family name is taken into account, which requires the need to transfer it to the heirs and not be able to sell it or evaluate it for money, but this transfer sparked a jurisprudential and legal controversy in the comparative legislation with the absence of provisions for Algerian legislation.
