القيمة القانونية للتوقيع الإلكتروني

Résumé: يعتبر الوفاء الإلكتروني أهم مميزات التجارة الإلكترونية فهو يتم عبر وسائط إلكترونية، التي تثير مسائل قانونية يتعلق بالإثبات إذ تهدف هذه الدراسة إلى توضيح علاقة هذه الوسائل بالتوقيع الإلكتروني ودوره في إثبات الدفع الإلكتروني، خاصة مع الأهمية التي أولاها التشريع له نظرا لاستعماله في وسائل الدفع الإلكتروني المختلفة. على إثر هذه الدراسة التي توصلت إلى أن وسائل الدفع الإلكترونية تؤدي وظيفتين قانونيتين هما الدفع والإثبات معا، فهي تعتمد على مجموعة من التقنيات التي توفر الحماية اللازمة للمعلومات التي تحملها ومنها التوقيع الإلكتروني من الأخطار التي تهددها في فضاء الانترنيت، كما تدخل التقنية في إنشاء التوقيع الإلكتروني وتمنحه درجة من الحجية بالإضافة إلى الاعتراف التشريعي بهذا الأخير فإنه تبنى مصطلحات ومفاهيم تستعمل في تكنولوجيا المعلومات لتعريف التوقيع الإلكتروني ووسائل الدفع ليشمل بذلك كل ما يمكن أن يصدر في المستقبل من تقنيات. The electronic payment is an important feature of electronic commerce as it is done trough electronic media, wich raises legal issues related to proof, this study aims to clarify these means by signing and its role in proving electronic payment, especially with the importance given to it by legilation due to it use in various electronic payment methods. Based on this study, which conclude that electronic means of payment have two legal functions of payment and proof, they rely on set of technologies that provide the necessary protection of the information they carry, including electronic signature of the threats that threaten them in the internet, and provide it with a degree of legitimacy in addition to legislative recognition of the latter, it adopted terms and concepts used in information technology to identify the electronic signature and means of payment to include all possible future technologies.
