آليات الوقاية من الفساد في الصفقات العمومية في التشريع الجزائري_أساليب البحث والتحري أنموذجا

Résumé: من المتعارف عليه أن الجرائم المتعلقة في مجال الصفقات العمومية أصبحت بمثابة الوباء الذي يهدد و بشكل واضح جميع الجوانب التي تقوم عليها الدولة وعلى كافة المستويات عموما و الجانب الاقتصادي خصوصا، وهو ما تسببت عنه العديد من الفضائح الاقتصادية نذكر منها قضية الخليفة، قضايا سونطراك المتعددة، و مؤخرا فضائح اقتصادية بالجملة، أبرزها القضايا العديدة لمنح امتيازات الغير مبررة من طرف العديد من الوزراء السابقين والحاليين وذلك في مجال الصفقات العمومية. وهو ما جعل المشرع الجزائري يحيطها بجملة من القواعد الموضوعية والإجرائية بما تحويه من أساليب البحث والتحري في هذه الجرائم الماسة بالصفقات العمومية، بغرض ضمان أكبر شفافية ممكنة لها وحماية لها من كل صور الفساد، ومنه فإن اشكالية هذه الورقة البحثية تمحوت في التالي: ما مدى فعالية السياسة الجنائية المنتهجة من طرف المشرع الجزائري في مكافحة جرائم الصفقات العمومية؟، وفي سبيل البحث فيها تم التوصل لجملة من النتائج أهمها أن السياسة القمعية المرصودة من طرف المشرع الجزائري لمكافحة هذه الجرائم لم تكن رادعة الى الحد المرجو منها، ودليل ذلك أن الواقع قد أثبت أن جرائم الصفقات العمومية في تزايد مستمر و بالأخص جنحة منح الإمتيازات الغير مبررة في مجال الصفقات العمومية. Abstract: It is well known that crimes related to the field of public deals have become an epidemic that clearly threatens all aspects on which the state is based and at all levels in general and the economic aspect in particular, which has caused many economic scandals, including the case of the khalifa , the various Sonatrach cases, And recently, wholesale economic scandals, most notably the numerous cases of granting unjustified privileges by many former and current ministers, in the field of public procurement. Which made the Algerian legislator surround it with a set of substantive and procedural rules, including the methods of research and investigation in these crimes affecting public deals, in order to ensure the greatest possible transparency and protect them from all forms of corruption. The criminal policy adopted by the Algerian legislator in combating public procurement crimes?, and in order to search for it, a number of results were reached, the most important of which is that the repressive policy monitored by the Algerian legislator to combat these crimes was not deterrent to the extent desired, and the evidence for this is that reality has proven that Public procurement crimes are on the rise, especially the misdemeanor of granting unjustified privileges in the field of public procurement.
