التسرب في التشريع الجزائري بين حتمية الاثبات وحماية الحياة الخاصة

Résumé: الملخص: من أجل منع ومكافحة الجرائم الخطيرة والمنظمة أقر المشرع أسلوب التسرب كإجراء لمكافحة الظاهرة الاجرامية والحد منها، وهذه الجرائم مذكورة على سبيل الحصر في قانون الاجراءات الجزائية وهي جرائم المخدرات، الجريمة المنظمة العـابرة للحـدود الوطنية، الجرائم الماسة بأنظمة المعالجة الآلية للمعطيات، جرائم تبييض الأموال، الإرهاب، الجرائم المتعلقـة بالتشـريع الخاص بالصرف وكذا جرائم الفساد. وهذه التقنية – التسرب – بالغة الخطورة والتعقيد تخضع لشروط محددة للغاية على النحو المُحدد في القانون حفاظا على حق الدفاع من جهة وحماية للقائم بعملية التسرب من جهة أخرى. Summary: In order to prevent and combat serious and organized crimes, the legislator approved the leakage method as a measure to combat and reduce the criminal phenomenon, and these crimes are mentioned exclusively in the Code of Criminal Procedures, namely drug crimes, transnational organized crime, crimes involving automated data processing systems, money laundering crimes, terrorism Crimes related to exchange legislation, as well as corruption offenses. This technology - leakage - is very dangerous and complex, subject to very specific conditions as specified in the law in order to preserve the right of defense on the one hand and the protection of the leaker on the other hand.
