مبدأ التقاضي على درجتين أمام محكمة الجنايات

Résumé: تماشيا مع التعديل الدستوري لسنة 2016 الذي كرس مبدأ التقاضي على درجتين في المواد الجزائية وضمانا لدستورية النصوص القانونية فقد عدّل المشرع الجزائري قانون الإجراءات الجزائية بموجب القانون رقم 17-07 الصادر بتاريخ 27 مارس 2017 ليقر هذا المبدأ لأول مرة في مواد الجنايات حيث تم استحداث محكمة جنايات ابتدائية ومحكمة جنايات استئنافية بمقر كل مجلس قضائي، ذلك أن محكمة الجنايات تنظر في أخطر الجرائم فكان من الضروري أن يعيد المشرع النظر في منظومة التقاضي أمامها، وبذلك يكون قد عزز ضمانات المحاكمة العادلة وفقا للمعايير الدولية التي سنتها الاتفاقيات الدولية المصادق عليها من طرف الجزائر، وهذا ما شكل تحولا بارزا في النظام القضائي الجزائي الجزائري بعد أن كانت محكمة الجنايات تصدر أحكاما ابتدائية نهائية لا تقبل الطعن فيها بالاستئناف. Abstract: In line with the constitutional amendment of 2016, which enshrines the principle of litigation in two categories in criminal law and in guaranteeing the constitutionality of the legal texts, the Algerian legislator amended the Code of Criminal Procedure under Law No. 17-07 of 27 March 2017 to adopt this principle for the first time in criminal cases where a criminal court And the Court of Criminal Appeals at the headquarters of each judicial council, as the Criminal Court is considering the most serious crimes was necessary to reconsider the lawmaker to consider the system of litigation before it, thereby strengthening the guarantees of a fair trial in accordance with international standards established by ratified international conventions By Algeria, This marked a major shift in the Algerian criminal justice system after the Criminal Court issued final final judgments which could not be appealed against.
