حرية الرأي والتعبير، الضمانات القانونية لممارستها والقواعد الدستورية التي تحكمها

Résumé: الملخص: تهدف الدراسة إلى إبراز أهمية حرية الرأي والتعبير باعتبارها من الحقوق الأساسية للإنسان، ونظـراً لأهمية هذا الحق للفرد والدولة معاً، أكدت الشرعة الدولية عليه ووضعت المعايير المقبولة لممارسته، و يرتبط الحق في حرية الرأي والتعبير بحقوق وحريات أخرى، بعـضها لازم يعتمد عليها والأخرى من مظاهره ووسائل ممارسته، وتوصلنا من خلال دراستنا إلى أنه لا يمكن أن نتصور ممارسة هذا الحق بدون حرية الحصول على المعلومات، وكذلك اعتبار الحق في حرية الرأي والتعبير هو حق دستوري وتركه دون قيود يؤدي إلى الإخلال بالنظام العام والآداب العامة والأمن العام، والمساس بحقوق وحريات الآخرين. Abstract The study aims at highlighting the importance of freedom of opinion and expression as a fundamental human right, and considering the importance of this right for the individual and the State together, the International Bill emphasized it and established acceptable standards for its exercise, and the right to freedom of opinion and expression is not linked to other rights and freedoms, including its essential and reliable and other manifestations and means of exercising it. Our study found that we could not envision the exercise of this right without free access to information, as well as that the right to freedom of opinion and expression was constitutional and left unfettered to disturb public order, morals and public security, and to prejudice the rights and freedoms of others.
