عقد البيع الدولي للبضائع

Résumé: يعتبر عقد البيع الدولي للبضائع أكثر عقود التجارة الدولية انتشارا وأشهرها على الإطلاق، حيث أن غالبية المبادلات التجارية الدولية وعمليات الاستيراد والتصدير تتم عن طريقه . وفي ضل التطورات الاقتصادية المتلاحقة وتداعيا لأفكار العولمة تبلور فرع جديد ينظم المعاملات الاقتصادية الدولية وهو ما يسمى بقانون التجارة الدولية وقد سعى إلى تنظيم أهم العقود الدولية التي من بينها عقد البيع الدولي للبضائع . ولما كان لهذا دور كبير في المعاملات التجارية الدولية، حيث تتخطى آثاره القيمة المرجوة منه إلى تأثيره الهام على غيره من العقود الدولية مما كان له أبلغ الأثر في توحيد قواعد البيع الدولي من خلال الاتفاقيات الدولية التي استلهمت نصوصها من الأنظمة القانونية عن . تنظيم قواعد وأحكام البيع الدولي ألا وهي اتفاقية فينا 0891 وقد اعتمدنا في تقسيمنا لبحثنا هذا علي المنهج الذي اعتمدت عليه اتفاقية فيينا لدراسة عقد البيع الدولي للبضائع والتي كانت كالتالي: الفصل الأول: إب ا رم عقد البيع الدولي للبضائع والذي قسم إلى ثلاثة مباحث المبحث الأول مفهوم عقد البيع الدولي للبضائع المبحث الثاني الطبيعة الدولية لعقد بيع البضائع المبحث الثالث تكوين عقد البيع الدولي للبضائع واثباته. أما الفصل الثاني فتطرقنا إلى الإلتزامات الناشئة عن عقد البيع الدولي للبضائع وقسمناه إلى مبحثين المبحث الأول التزامات البائع وجزاء الإخلال بها المبحث الثاني التزامات المشتري. international commercial Contracts where the majority of the international trade exchanges and the import and export operations go through it. Under the successive economic developments and the globalizations a new branch has appeared which is charged in the International economic deals. It has come under the name of the international commercial law which worked hard to organize the most important international contracts that include the international sale contract of goods .And because it had an important role in the international commercial deals that it could influence on the other international contracts by unifying the international sale of rules through international conventions which inspired their texts from the legal system for setting international sale rules which is “ Vienna conventions 1980”. We have relied when dividing this research on the approach that was adopted by Vienna conventions in studying the international sale contract of goods which was as the following:  Chapter one: ratification of the international sale contract of goods which was divided into three sections. The first section includes a conception of the international sale contract of goods. The second talks about the international nature of the sale of goods contract and the last one speaks about forming the international sale contract of goods and proving it.  Chapter two: in this chapter we have dealt with the liabilities arising from contract for the international sale of goods that we divided it into two sections. The first concerns the obligations of the seller and the penalty for those who do not follow them. And the last one deals with the buyer’s obligations.
