فاعلية قرار التحكيم الإلكتروني في منازعات التجارة الدولية

Résumé: يعتبر التحكيم الالكتروني من اهم الوسائل الحديثة لفض منازعات التجارة الدولية خاصة الالكترونية منها ،ويعد صدور قرارات إلكترونية من قبل هيئة التحكيم هو المرتجى من لجوء أطراف النزاع الى التحكيم الإلكتروني . ولا يعني صدور قرار التحكيم الالكتروني نهاية كل إشكاليات التحكيم فهناك إشكاليات تبرز أثناء تنفيذ الحكم ، خاصة أن قرار التحكيم الإلكتروني الذي يصدره المحكم أو هيئة التحكيم يتم بالوسائل الالكترونية سواء الكتابة او التوقيع، وهذا يستلزم توفير القواعد القانونية اللازمة لتنظيمه ، والتي تفتقر اليها غالبية تشريعات دول العالم المختلفة. Electronic arbitration can be considered one of main developed means to settle international trade disputes, particularly electronic ones. Besides, the issuance of electronic awards by the arbitral tribunal is considered a fundamental objective when the parties to a dispute resort to electronic arbitration. However, if electronic arbitration award is rendered, it may not imply the end of all problems of arbitration. This is mainly due to problems that may arise while serving the sentence, especially when the electronic arbitration award issued by the arbitrator or the arbitral tribunal is made by electronic means, either in writing or signature. Furthermore, electronic arbitration may require relevant laws necessary to regulate it, and that is lacking in the legislation of the majority of the world’s nations
