العقد الإداري الإلكتروني - دراسة مقارنة -

Résumé: يتناول موضوع الدراسة ماهية العقد الإلكتروني من حيث تعريفه في شقيه المدني و الإداري و خصائصه و معاييره التي تميزه عن العقد العادي، و مزايا التعاقد الإلكتروني المجسدة فيما تحققه للإدارة من توفير في الجهد و المال و الوقت و الحد من مظاهر التلاعب و الفساد. بالإضافة إلى البحث في كل مراحل هذا العقد، من إبرام و ما يتطلبه من مراعاة للأحكام العامة للعقود الإدارية و مدى تأثير إستعمال الوسائل الإلكترونية عليها ، و على شكلته المجسدة في المحررات و الكتابة الإلكترونية و التوقيع الإلكتروني، و كذا طرق الإبرام الإلكترونية له و المتبوعة بتنفيذه الإلكتروني سواء بشكله المعنوي أو المادي و ما يترتب عنه من آثار. Abstract: The subject of the study deals with the definition of the electronic contract in terms of its definition in its civil and administrative aspects, its characteristics and standards that distinguish it from the ordinary contract, and the advantages of electronic contracting embodied in the savings achieved by the administration in terms of saving effort, money and time, and limiting the manifestations of manipulation and corruption. In addition to researching all stages of this contract, from the conclusion and requirements of the general provisions of administrative contracts and the extent of the impact of the use of electronic means on them, and on its form embodied in the documents, electronic writing and electronic signature, as well as the electronic methods of concluding it and followed by its implementation Electronic, whether in its intangible or physical form, and its implications.
