حماية خيار العدول للمستهلك في التعاقد الإلكتروني

Résumé: يعتبر حق العدول عن العقد من بين أهم البيانات الإلزامية التي يجب أن تتضمنها العقود الإلكترونية التي تنعقد عن بعد، ويعد من أهم الضمانات المستحدثة لحماية الطرف الضعيف في العلاقة العقدية ألا وهو المستهلك، ويعتبر كاستثناء وارد على مبدأ القوة الملزمة للعقد، نظرا لكون المتعاقد عن بعد ليس لديه من الوسائل ما يكفل معاينته للسلعة والإلمام بخصائصها قبل إبرام العقد. وقد أقرت هذا الحق معظم التشريعات المقارنة المنظمة للتعاقد عن بعد التي قيدت استعماله بقيود زمنية محددة، وكذا استثنت بعض العقود التي لا يشملها استعمال هذا الحق، مع العلم أنه في حالة التمسك بهذا الأخير ينتج عنه آثار قانونية هامة. The right to waive a contract is one of the most important obligatory data that should be included in electronic contracts that are held remotely. It is considered one of the most important guarantees to protect the consumer in the contractual relationship and an exception toward the principle of the force committing the contract, because the distance contractor does not have any means to ensure the inspection of the commodity contract's conclusion. This right is recognized by most of legislations governing the comparison of distance contracting by restricting its use in specific time limits, excepting some contracts not covered by the use of this right, knowing that it would lead to significant legal effects in the case of its maintaining.
