Résumé: تعتبر إجراءات تسوية عوارض الدفع في الشيك سبب من أسباب انتفاء جريمة شيك بدون رصيد حيث وضع المشرع مجموعة من الإجراءات تبدأ بإحداث بطاقية للمستحقات غير المدفوعة على مستوى بنك الجزائروتبليغها للبنوك المؤسسات المالية من أجل أخذها بعين الاعتبار عند فتح الحسابات البنكية لزبائنها، كما منح الساحب المخالف مهلة لتسوية عارض الدفع من أجل اعفائه من المسؤولية الجنائية، كما فرض مجموعة من العقوبات كغرامة التبرئة والمنع من إصدار الشيكات، وألزم البنوك والمؤسسات المالية بتطبيق هذه العقوبات وحملهم المسؤولية المدنية بالتضامن مع الساحب المخالف في حالة الإهمال وعدم تطبيق النصوص القانونية والتنظيمية.
