مبدأ التقاضي على درجتين في النظام القضائي الإداري الجزائري
Résumé: حاول المشرع الجزائري تكريس مبدأ التقاضي على درجتين في النظام القضائي الإداري الجزائري، رغم التحولات العديدة التي عرفها القضاء الجزائري بصفة عامة والهرم القضائي الإداري بصفة خاصة ، بالرغم من أن هذا المبدأ مكرس في السابق من خلال وجود محكمة إدارية كقاعدة للهرم القضائي الإداري الجزائري و مجلس الدولة كدرجة ثانية، إلا أنه كرس فعليا بعد التعديل الدستوري 2020 وبذلك تم استحداث محكمة إدارية للإستئناف تتوسط الهرم القضائي الإداري الجزائري. الكلمات المفتاحية: المحكمة الإدارية، مجلس الدولة، المحكمة الإدارية للإستئناف. Abstract: The Algerian legislator tried to enshrine the principle of litigation on two levels in the Algerian administrative judicial system, despite the many transformations known to the Algerian judiciary in general and the administrative judicial hierarchy in particular, although this principle was enshrined in the past through the presence of an administrative court as a base for the Algerian administrative judicial hierarchy and the State Council As a second degree, however, it was actually enshrined after the 2020 constitutional amendment, and thus an administrative court of appeal was created in the middle of the Algerian administrative judicial pyramid.
