الخصوصية الإجرائية للجريمة الجمركية في التشريع الجزائري
Résumé: الجرائم الجمركية من أخطر الجرائم التي تهدد الاقتصاد الوطني، ولذلك قام المشرع الجزائري بالنص على إجراءات خاصة لضبطها بعيدا عن الإجراءات الموجودة في القانون العام، حيث قام بإسناد مكافحتها إلى إدارة الجمارك وفق قانون الجمارك وقانون مكافحة التهريب بالإضافة إلى الإجراءات المنصوصة في القانون العام. كما نستنتج أن المشرع الجزائري لم يكتف بإثبات الجريمة الجمركية بالطرق الخاصة المنصوص عليها في قانون الجمارك، وإنما أجاز إثباتها بكافة الطرق القانونية، وحدد القيمة الإثباتية لها. الكلمات المفتاحية: جريمة جمركي، التحقيق الجمركي، الحجز الجمركي. الفحص الوثائقي. Abstract : Customs crimes are among the dangers of crimes that threaten the national economy, and therefore the Algerian legislator has adopted special procedures to control them away from the procedures found in public law, as he assigned the fight against them to the customs administration in accordance with the customs law and the anti-smuggling law, in addition to the procedures stipulated in the public law. We also conclude that the Algerian legislator has not only established the customs offence by the special means provided for in the Customs Code, but has also authorized its proof by all legal means and has determined its evidentiary value.
