الحماية القانونية للطفل في التشريع الأردني والمواثيق الدولية (دراسة قانونية في مجال الرعاية الصحية والتعليم والعمل والزواج)

Résumé: تعنى هذه الدراسة بتسليط الضوء على الحماية القانونية للطفل من خلال النصوص القانونية الناظمة لمجالي الصحة والتعليم، وحيث إن المصلحة الفضلى للطفل تقتضي السماح له بممارسة بعض حقوق الشخص البالغ فقد نظم المشرع الأردني مسألتي عمل الطفل وزواجه، الأمر الذي أوجب تحديد حقوق الطفل في هذين المجالين. وقد توصلت الدراسة إلى عدة نتائج منها أن المشرع الأردني قد راعى مصلحة الطفل الفضلى في مسألتي صحة الطفل وتعليمه، فجعل نفقتهما على الأب، فإذا كان معسرًا فتكون نفقتهما على الأم دينًا في ذمة الأب. كما أوصت الدراسة بضرورة تشديد إجراءات زواج الطفل وعدم تسهيلها للحد من الزواج المبكر وجعله في أضيق نطاق. This study aims to highlight the legal protection of the child through analyzing the legal articles in the fields of health and education. Moreover, and since the best interest of the child is to allow him/her to exercise some of the rights of the adults, the Jordanian legislator has organized the issues of child labor and marriage, which necessitated the identification of children's rights in these areas. The study concluded that the Jordanian legislator took into account the best interest of the child in the issues of child health and education, so that the child's father will be held financially responsible of covering the costs of these benefits. On the other hand, and in the case of the fathers insolvent, the child's mother will be held responsible of covering the needed expenses, which will be considered as a debt that should be paid back by the father when capable. The study recommended the need to constrict child marriage procedures in order to reduce early marriage cases and make it in the narrowest range
