آليات مكافحة الاستغلال التعسفي لوضعية التبعية الاقتصادية في قانون المنافسة الجزائري "بين النصوص القانونية والتطبيق الفعلي"

Résumé: تهدف هذه الدراسة إلى التطرّق إلى نوع من أنواع الممارسات المقيّدة للمنافسة والمتمثّل في الاستغلال التعسّفي لوضعيّة التبعية الاقتصادية، من خلال التعرّف على مفهوم وضعية التبعية وتحديد شروط حظرها في قانون المنافسة الجزائري وفي القانون الفرنسي والأوروبي، والتي سنلاحظ من خلالها توسيع المشرّع الجزائري لنطاق حظر هذه الممارسة من خلال تعداد صورها رغبة منه في مكافحة هذه الممارسة من أجل المحافظة على حرية المنافسة. غير أنّنا نتساءل عن مدى التطبيق الفعلي لأحكام التعسّف في التبعية الاقتصادية، ونخلص من خلال هذه الدراسة إلى بعض الثغرات القانونية التي تضمّنها قانون المنافسة في مجال مكافحة الاستغلال التعسفي لوضعية التبعية الاقتصادية. This study aims to address the type of practices that are restrictive to competition, namely the arbitrary exploitation of the situation of economic dependence. This is done by identifying the concept of the status of subsidiarity and defining the conditions for its prohibition in the Algerian competition law and in French and European law. Through this study, we will note that the Algerian legislature broadens the scope of the prohibition of this practice by enumerating its forms in order to combat this practice in order to preserve the freedom of competition. However, we question the extent to which the provisions of arbitrariness in economic dependency are actually applied, and we conclude through this study some of the legal gaps in competition law in combating the arbitrary exploitation of the status of economic dependency
