خصوصية التنظيم القانوني لمعالجة جريمة الصرف في الجزائر

Résumé: تتسم جريمة الصرف من حيث الأركان المشكلة لها بخصوصية خاصة تميزها عن عديد الجرائم ‏الكلاسيكية المنصوص في إطار الأحكام العامة لقانون العقوبات ، ذلك أن هذه الجريمة على الرغم ‏من كونها جريمة واحدة إلا أن ركنها المادي يتخذ عدة صور و أشكال مما يوحي بأنها أكثر من ‏جريمة ، كما أن الركن المعنوي الخاص بهذه الجريمة يتباين من حيث السلوكات المشكلة للركن ‏المادي بين ما يفترض فيها الخطأ الجزائي و بين ما يتعين معها إثبات القصد الجنائي ، ‏ و يقتضي كأصل عام قمع أي جريمة ، إحاطتها بجملة من التدابير الخاصة بمتابعة الأشخاص ‏المتهمين و ترتيب الجزاءات المناسبة لها مع مراعاة خصوصية كل جريمة و هو حال جريمة ‏الصرف التي نحن بصدد دراسة خصوصيتها ، و فضلا عن ذلك قام المشرع الجزائري في مادة ‏جريمة الصرف باعتماد نظام المصالحة كإجراء بديل يمكن إعماله بدل عن المتابعة الجزائية ‏طبعا إذا توفرت شروطه و ضوابطه .‏ Abstract: The crime of exchange in terms of its forming elements is characterized by ‎a special particularity that distinguishes it from classic crimes stipulated in ‎the general provisions of Penal Code, since this kind of crimes, despite ‎being a single one, its physical element takes several forms suggesting that ‎it is more than one crime; moreover, the moral element of this crime varies ‎according to acts forming the physical element, waither it is a criminal error ‎or an intentional crime.‎ As a general rule, to suppress any crime it is necessary to put in place a set ‎of appropriate measures for the following-up and sanctions, considering ‎specificity of each one, which is the case of exchange crime, and in ‎additional to that, the Algerian legislator in this matter has adopted the ‎reconciliation as an alternative measure that can be implemented instead of ‎penal prosecution whenever its suitable conditions and regulations are met.‎
