مكانة قرارت المنظمات الدولية بين مصادر القانون الدولي العام

Résumé: ملخص: لقد عرف القانون الدولي تطورا في أشخاصه، فبعدما كانت الدولة الشخص الدولي الوحيد، ظهرت العديد من المنظمات الدولية، والتي ساهمت في مجال العلاقات الدولية، عن طريق ما تصدره من قرارات وتوصيات، تساهم في تكوين قواعد القانون الدولي، مما جعل فقهاء القانون الدولي يهتمون بمختلف القرارات الصادرة عن المنظمات من حيث أنواعها وآثارها، خاصة بعد الاعتراف للمنظمة الدولية بالشخصية القانونية، على أن فقهاء القانون الدولي اختلفوا بين مؤيد ومعارض حول اعتبار قرارات المنظمات الدولية من مصادر القانون الدولي العام، خاصة لعدم ذكرها في نص المادة الثامنة و الثلاثون من النظام الأساسي لمحكمة العدل الدولية، رغم أن المنظمات الدولية أصبحت تلعب دورا في الحياة الدولية جعلها قادرة على خلق قواعد قانونية دولية. Abstract: International law knew an evolution in its persons. After the state was the only international person, several international organizations have emerged, which have contributed to the field of international relations through the decisions and recommendations they make to contribute to the formation of the rules of international law. This made international law jurists pay attention to the various decisions issued by organizations in terms of their types and effects, especially after the recognition of the international organization as a legal personality. However, international law jurists differed between supporters and opponents about considering the decisions of international organizations as sources of general international law, especially for not mentioning them in the text of the Article thirty eight of the Statute of the International Court of Justice, despite the fact that international organizations became playing a part in international life that made them able to create international legal rules.
