ضمانات حماية ضحايا الاختفاء القسري أثناء النزاعات المسلحة

Résumé: الاختفاء القسري للأشخاص أثناء النزاعات المسلحة، هي جريمة ضد الإنسانية، وانتهاك جسيم لحرياتهم، مصدر تجريمها يرجع إلى قواعد القانون الدولي الإنساني العرفية والمكتوبة، التي وضعت ضمانات الحماية قبل ارتكاب الجريمة، من خلال التزام أطراف النزاع المسلح بمنع ارتكابها وتجريمها، وضمانات عند ارتكابها، بمحاكمة المتسببين فيها مهما كانت درجة مسؤولياتهم وعدم إفلاتهم من العقاب، وتعويض الضحايا عن الضرر الذي تعرضوا له. ولكن تجسيد هذه الضمانات يعتمد على آليات دولية تفرض الالتزام بها وعدم انتهاكها، من خلال دور الوقاية والرصد والمراقبة والتنبيه الذي تقوم به المنظمات الدولية، ودور الردع والعقاب الذي تقوم به المحكمة الجنائية الدولية. The enforced disappearance of persons during armed conflicts, is a crime against humanity and a gross violation of their freedoms, the source of its criminalization is due the customary and written rules of international humanitarian law, which established guarantees of protection before the crime was committed, through the commitment of the parties to the armed conflict to prevent its commission and criminalize them, and guarantees when they are committed that those responsible will be brought to court, regardless of their responsibilities, and not with impunity, and compensate the victims for the damage. However, the materialization of these guarantees depends on international mechanisms that enforce their commitment and non violation, through the prevention, monitoring and alerting role of international organizations, and the punishment role played by the international criminal court.
