إختصاص المحكمة الجنائية الدولية بنظر الجرائم البيئية المرتكبة في وقت النزاع المسلح الدولي
Résumé: لقد تطرقنا في هذه الورقة البحثية إلى مدى إختصاص المحكمة الجنائية الدولية للنظر في الجريمة البيئية المرتكبة في وقت النزاع المسلح الدولي، بإعتبارها جريمة حرب أو جريمة عدوان.ولقد توصلنا إلى أن النظام الأساسي للمحكمة الجنائية الدولية، إعتبر بطريقة مباشرة التعدي على البيئة يشكل جريمة حرب و بطريقة غير مباشرة إعتبرها جريمة عدوان ، ولكن بشروط معينة يجب توافرها في فعل التعدي على البيئة في كلتا الجريمتين.criminal courts jurisdiction to consider environmental crime commited at the time of the international armed conflict as a war crime or a crime of aggression.we have concluded that the statute of the international criminal court considered,in a direct way, the violation of the environment as war crime,and indirectly,it considered it a crime of aghresion,but certain conditions must be met in the act of violating the environment in both crimes
