القاضي الجزائي بين واجبي القمع و ضمان قرينة البراءة

Résumé: قرينة البراءة مبدأ إجرائي يحكم التحقيق الجنائي والمحاكمة،وكل الفاعلين في الدعوى العمومية ملزمون باحترامه، وجهة الاتهام تحمل عبء الإثبات بشكل لا يدع مجالا للشك أن المتهم ارتكب الأفعال المتابع عليها، والقاضي لو أحس بشك ولو كان بسيطا عليه أن يفسره لمصلحة المتهم، لكن القاضي الذي يحقق أو ينظر في الدعوى الجزائية تفرض عليه قيود إجرائية تلزمه أحيانا بتقييد أو سلب حرية المتهم الذي مازال في مرحلة التحقيق بتقرير الحبس المؤقت بل حتى قبلك ذلك من خلال آلية التوقيف للنظر في حالة الاشتباه، فيجد نفسه أمام تنازع بين حق الشخص في افتراض براءته ومعاملته على هذا الأساس في كل مراحل الدعوى الجزائية وهو حق دستوري على القاضي ضمانه في كل مراحل الدعوى الجزائية في ظل حق المواطنين في المعلومة وحرية الإعلام لاسيما إذا تعلق الأمر بقضايا تتهم فيها شخصيات عامة،هذا من جهة ومن جهة أخرى واجب القمع الواقع على عاتق القاضي، علما أن المشرع لم يحدد آليات قانونية لحل هذا التنازع. Abstract: The presumption of innocence is the legal principle that one is considered innocent until proven guilty. This concept which concerns the burden of proof is a cardinal principle of most legal systems across the world including Algeria. It serves to emphasize that the prosecution must prove each element of the offense beyond a reasonable doubt; it is also recognized as a human right by national and international texts. It is imperative that a criminal trial is fair, and determined by an impartial judge,it’s a great challenge for him to deliver a fair judgment concerning lot of crimes. This article discusses the problematic according the criminal judge can guarantee the presumption of innocence and also the repression especially with the employer representing the media in criminal trials by seeking the basis of this principle, the field of its application besides the means of its protection.
