التعويضات المالية للمطلقة عن فك الرابطة الزوجية - دراسة مقارنة بين الشريعة الاسلامية وقانون الأسرة الجزائري -

Résumé: ملخص: من التعويضات المالية كحق للمطلقة المتعة والتعويض، أما المتعة لم يختلف الفقهاء حول مشروعيتها، بحيث أجمعوا على ذلك وكان دليلهم الآيات القرآنية الكريمة من سورتي البقرة والأحزاب، واختلفوا في درجة مشروعيتها، مقدارها ومعيار تقديرها، في حين أن "التعويض" مصطلح جديد عند الفقهاء المعاصرين، وعرف بداية بـ"الضمان". أما المشرّع الجزائري فتناول موضوع التعويض عن الطلاق التعسفي في الباب الثاني وفي المادة 52 من ق.أ.ج بالصريح في حين لم يذكر موضوع المتعة، ورغم ذلك إلا أن قرارات المحكمة العليا قضت بالمتعة ولكنها وقعت في خلط بين الحقين (المتعة والتعويض)، نظرا للتقارب والاشتراك في العلة التي هي جبر الضرر؛ فأحيانا يحكم بالمتعة وأحيانا يحكم بالتعويض، وأحيانا يحكم بهما معا، ولذا جاء هذا البحث يهدف إلى إجراء مقارنة للتفريق بين المتعة والتعويض عن الطلاق التعسفي، وهل لهما نفس المعنى في الفقه والقانون ؟ Abstract: Of financial compensation as the right of the absolute pleasure and compensation, and the pleasure did not disagree jurists on the legitimacy, so they unanimously agreed that the koranic verses from the Suras and al-Baqarah were different, but disagreed in the degree of their legitimacy, the amount of them, while "compensation" is a new term for contemporary jurists .
