الإطار القانوني لحق الإنسان في حرية الديانة في الجزائر

Résumé: تعتبر حرية الديانة واحدة من أبرز المواضيع التي تناولتها علوم مختلفة ، فهي رباط اجتماعي أثبت الأنثروبولوجيون و علماء الأديان و رجال القانون من خلال دراساتهم استحالة أن يكون المجتمع كلاّ متجانسا إلاّ إذا تقاسم الأفراد عقيدة تجمعهم . و من المنظور القانوني عالج المشرع الجزائري هذا الموضوع الحساس و أصدر نصوصا قانونية تنظم حرية الديانة للمسلمين و غير المسلمين بناءا على الإتفاقيات الدولية ذات الصلة بحقوق الإنسان و التي صادقت عليها الجزائر ، إلاّ أنّ إتباع الديانات الأخرى غير الإسلام لا زالوا يعتبرون توجه المشرع الجزائري فيه تقييد لحرية المعتقد ، وهو ما ذهبت إليه المنظمات الدولية لحقوق الإنسان . Freedom of religion is one of the most prominent topics dealt with in different sciences. It is a social bond. Anthropologists, religious scholars, and jurists have proven through their studies that it is impossible for society to be a homogeneous whole unless individuals share a belief that unites them. From a legal perspective, the Algerian legislator has dealt with this sensitive issue and issued legal texts regulating the freedom of religion for Muslims and non-Muslims based on international conventions related to human rights that Algeria has ratified. However, the followers of religions other than Islam still consider the Algerian legislator’s approach to restrict Freedom of belief, which is what international human rights organizations have gone to.
