الآليات القانونية لتنفيذ القرار الإداري في التشريع الجزائري

Résumé: Abstract This research paper aims to study the mechanisms of implementation of the administrative decision in Algerian legislation, which differ between the method of implementation by choice or voluntary, which is the original in implementation, and a compulsory method, which is exceptional in implementation, where the administration resorts to direct administrative implementation and indirect judicial implementation to implement its failed decisions. The research found that the legislator has strived in parallel with judicial jurisprudence, whether in Algerian legislation or comparative legislation, to surround forced execution with a set of guarantees in order to protect rights from the arbitrariness of the administration while intensifying judicial control over the discretionary power exercised by the administration within the framework of forced execution. الملخص تهدف هذه الورقة البحثية لدراسة آليات تنفيذ القرار الإداري في التشريع الجزائري، التي تختلف بين أسلوب التنفيذ الاختيار أو الإرادي وهو الأصل في التنفيذ، وأسلوب إجباري وهو استثنائي في التنفيذ حيث تلجأ الإدارة للتنفيذ المباشر الإداري والتنفيذ الغير المباشر القضائي لتنفيذ قراراتها المتقاعس عنها. وقد توصل البحث إلى أن المشرع سعى جاهدا بالموازاة مع الإجتهدات القضائية سواء في التشريع الجزائري أو التشريع المقارن لإحاطة التنفيذ الجبري بمجموعة من الضمانات بهدف حماية الحقوق من تعسف الإدارة مع تكثيف الرقابة القضائية على السلطة التقديرية التي تمارسها الإدارة في إطار التنفيذ الجبري.
