محاكم الاستئناف الإدارية ومبدأ التقاضي على درجتين

Résumé: انسجاما مع الأحكام التي جاء بها التعديل الدستوري لسنة 2020، أجرى المشرّع تعديلات في قوانين عديدة، الهدف منها هو توسيع نطاق إعمال مبدأ التقاضي على درجتين، وهو ما جعل الفقه يجزم بأنّ محاكم الاستئناف الإدارية ـــــــ المستحدثة بموجب ذات التعديل الدستوري ـــــــ ما هي إلاّ أثرٌ من آثار الارتقاء بمبدأ التقاضي على درجتين إلى مصاف المبادئ الدستورية؛ ولكن يُعترض على هذا الرأي، بأنّ المادة 165 فقرة 3 من التعديل الدستوري لسنة 2020 بنصّها على أن «يضمن القانون التقاضي على درجتين، ...» تضفي غموضا على القيمة القانونية لهذا المبدأ، فضلا على وجود نصوص تشريعية وردت في قوانين عضوية سبق وأن خضعت إلى رقابة المحكمة الدستورية تخرق مبدأ التقاضي على درجتين، وعلى الرغم من ذلك لم تثر المحكمة الدستورية مسألة عدم دستوريتها. In line with the provisions contained in the constitutional amendment of 2020, a several laws amendments has been made by legislator aiming by to extend the application of the principle of litigation of two degrees. Which led the jurisprudence to assert that the Administrative Appeals Tribunals - created by the same constitutional amendment - have only the effect of upgrading the principle of litigation of two degrees to level with constitutional principles; However, this view is challenged by the fact that article 165, paragraph 3, of the Constitutional Amendment of 2020, which provides that "the law shall guarantee litigation in two degrees..." Confusing the legal value of this principle, as well as the existence of legislative texts in organic laws already subject to the Constitutional Court's scrutiny that violate the principle of litigation in two degrees; nevertheless, the Constitutional Court did not raise the issue of its unconstitutionality.
