الرقابة القضائية على مشروعية القرارات الإدارية الفردية في تسيير الموظفين

Résumé: تمتع سلطة التعيين والتسيير الإداري بامتياز إتخاذ وإصدار القرارات الإدارية الفردية في تسيير الموظفين وأحيانا تتجاوز في ذلك إحترام مبدأ مشروعية القرارات الإدارية الفردية في تسيير الموظفين،فتعد دعوى تجاوز السلطة أو الإلغاء مكنة للموظف يطلب فيها إلغاء القرار الإداري الفردي غير المشروع ،إذ تعد من أهم الدعاوى الإدارية علي إعتبار أنها وسيلة فعالة وقوية لتحريك عملية الرقابة علي مشروعية القرارات الإدارية الفردية في تسيير الموظفين، لذلك يلجأ إليها الموظفون لمخاصمة القرارات الفردية المشوبة بعدم المشروعية ، وفق شروط وإجراءلت محددة قانونا للفصل فيها. . Summary: The power of appointment and administrative management has by excellency the propulsion in taking individual administrative decisions to manage the employees. and sometimes it exeeds the principle of respecting the legitimacy of individual administrative decisions in managing the employees. The lawsuit of the ultra power or the cancellation is a machine by which the employee requests to cancel the individual administrative decision. It is one of the most important administrative lawsuits because it is an effective and powerful means to push the operation of supervision and control on the legitimacy of the individual administrative decisions in managing the employees; that's why the employees dispute to the individual administrative decisions that lack legitimacy based on conditions and procedures reconciled from the law to be disputed.
