آليات حماية الأراضي الفلاحية في التشريع الجزائري

Résumé: عرفت الأراضي الفلاحية في القانون الجزائري حماية قانونية تجسدت من خلال مجموعة من القوانين ، بهدف حماية الأراضي الفلاحية ومنع التعدي عليها . وقد اعتمد المشرع اليات قانونية تهدف الى ضمان حماية فعلية وفعالة من اجل مكافحة التعدي على الاراض الفلاحية بعدم استغلالها أو بالبناء عليها أو بتجزئتها ، ويعتبر قانون التوجيه العقاري و قانون 08-16 المتضمن قانون التوجيه الفلاحي . القاعدة الاساسية لتفعيل هذه الحماية . .Abstract ; Agricultural lands in Algeria are protected through a set of laws that aim to prevent trespass on these lands,The legislator adopted legal mechanisms for a actual and effective protection a against trespass on agricultural lands through preventing the exploitation or fragmentation of these lands and prohibiting construction on it . the law of the real estate directive and the law 08-16 which contains the land directive Act are considered the fundamental basis to activate this protection . Key words; agricultural land property- duty to exploit- abuse of right – the agricultural destination – agricultural lands consolidation .
