فقه الموازنات و تطبيقاته في الاجتهاد القضائي المعاصر - الوصية الواجبة أنموذجا –

Résumé: يتلخّص موضوع هذا البحث في إبراز دور فقه الموازنات في حسم الخلاف في كثير من المسائل المستجدة، التي تتجاذبها المصالح و المفاسد، من خلال عرضها على قواعد الموازنات، للوصول إلى الرأي الأكثر دقّة، و موافقة لمقاصد الشريعة الإسلامية. و لما كان القضاء هو الميدان الذي يفصل فيه بين الخصومات، كان لزاما على القضاة أن يكونوا على درجة من العلم بفقه الموازنات، من أجل تصوّر المسألة تصوّرا دقيقا و النّظر في مآلاتها قبل تطبيق الحكم عليها. و لتحقيق هذه الأهداف، تمّ تطبيق الجانب النظري على مسألة لا يزال العلماء مختلفين بشأنها، و هي "الوصية الواجبة"؛ فحاولت إخضاعها لميزان قواعد الترجيح و الموازنات، مع إبراز جوانب الخلل و الاضطراب في الاجتهاد القضائي الجزائري فيها. This research highlights the role of Balance jurisprudence in resolving the dispute in many new life situations to access the most accurate view, which agrees the purposes of Islamic law. Since the judiciary is the field in which disputes are separated, judges need to have a degree of knowledge in the Balance Jurisprudence, to conceive the matter and adapt it carefully and consider its tasks before applying the judgment. In our paper, the theoretical aspect was applied to a question in which scholars still have controversial opinions. This is the "Imperative Testament". We present in this case the interests and depravations based on this balance, with some aspects given in the Algerian jurisprudence judgment.
