الاختيارات الفقهية للقاضي عبد الوهاب المالكي من خلال كتابه المعونة أحكام النكاح أنموذجا

Résumé: يعد القاضي عبد الوهاب البغدادي المالكي أحد أعلام المدرسة المالكية العراقية، حيث انتهت إليه رئاسة المذهب في عصره.  عاش القاضي عبد الوهاب خلال القرنين الرابع والخامس الهجريين، حيث عاصر الدولة العباسية إبان ضعفها السياسي والاقتصادي من جهة وازدهار الناحية العلمية من جهة أخرى.  عمل القاضي عبد الوهاب في مجال القضاء في عدة بلدان بالعراق وفي آخر عمره بمصر.  كتابا جامعا لفروع ومسائل الفقه المالكي من عبادات ومعاملات وجنايات وأقضيه مع ذكر » المع ونة « يعد كتاب الأدلة، وإشارته إلى رأي المخالفين.  إن مفهوم الاختيار هو استقلال الفقيه المجتهد بالرأي الفقهي لدليل.  إن اختيارات القاضي عبد الوهاب الفقهية في كتاب النكاح، هي من علم الخلاف العالي أو ما يسمى اليوم بالفقه المقارن، وأحيانا من الخلاف النازل وهو الخلاف داخل المذهب.ويختار منها على حسب ما تبين له من الأدلة الشرعية. Research summary  The judge Abdel ouahab Elmliki is considered as one of the famous in scholar in the Iraqi Malikia school. In his era he was nominated the leader of that school.  He lived during the fourth and the fifth higri century. He lived in the "Abbasi " state. He was a witness of its economic and political collapse and its scientific flourish.  He worked as judge in different towns in Iraq and Egypt.  In his book "El Mouna ", he gathered different issues of the Maliki jurisprudence: Worship, Transaction, crimes and issues with showing their evidences and showing the disagreement side.  The choosing concept means the independence of the diligent "Faqih" within his opinion based on the jurisprudence evidences.  The choosing in his book "El Nikah" is the knowledge high of disagreement or what is it called now the comparative jurisprudence and sometimes from the low disagreement. And it is the disagreement inside the "The Maliki School", and he chooses from it according what the legitimate evidences show him.
