الجوانب القانونية لاستخدام الذكاء الاصطناعي

Résumé: ملخص: إن تصنيف الذكاء الاصطناعي من قبيل الشخص المعنوي يتعارض وحقيقته المستمدة من قراراته المنفردة والمستقلة، وهو ما يدفع إلى ضرورة منحه شخصية قانونية إلكترونية قصد سد العجز الذي يعتريه، وذلك لإنصاف المضرور وتعويضه عن فعل الأضرار الناجمة عن نظم الذكاء الاصطناعي، نتيجة عجز قواعد المسؤولية التقليدية عن مواكبة التطور المتسارع للذكاء الاصطناعي الذي اخترق جميع المجلات، ما أدى إلى البحث عن تكريس نمط جديد من القواعد التي تقر بالمسؤولية عن فعل أجهزة الذكاء الاصطناعي. Abstract: The classification of the artificial intelligence such as a moral person , contradicts with its fact derived from its independent and individual decisions; which prompts necessity to grant it an electronic legal personality to fill the deficit , redress the injured , and compensate him for the damage resulting from the artificial intelligence systems, as well as the disablement of the traditional liability rules to keep up with the rapid development of the artificial intelligence which swept all fields , and led to search for a new style of rules which recognizing the liability of the artificial intelligence devices function.
