إلتزامات البلدان النامية تجاه اتفاقية الجوانب المتصلة بالتجارة من حقوق الملكية الفكرية (تريبس)

Résumé: تعتبر حقوق الملكية الفكريةعلى أنها حقوق اقتصادية وتجارية مثل ما هو الحال بالنسبة لاتفاقية "تريبس"، ولكن وصفها على أنها "حقوق" يجب ألا يخفي المعضلة الحقيقية الناجمة عن تطبيقها في الدول النامية.حيث تواجه هذه الأخيرة تحديات مؤسسية هائلة في تنفيذ الحماية للملكية الفكرية، حسبما تقضيه اتفاقية "تريبس". إذ أن غالبيتها لها قدرات علمية وتكنولوجية محدودة -الشيء القليل لكسبه من تنفيذ التزامات اتفاقية "تريبس"-. لذلك، فإن همها الرئيسي هو الحد من الكلفة البشرية وكلفة الموارد المنطوية على تأسيس أنظمة حماية للملكية الفكرية؛ وستحتاج الدول النامية الأكثر تقدما تكنولوجيا إلى الضمان بأن أنظمتها للملكية الفكرية، تكمل وتعزز سياساتها العريضة وهي تشجيع التطوير التكنولوجي والابتداع Intellectual property rights are considered as economic and commercial rights as is the case with the "TRIPS" agreement, but describing them as "rights" should not mask the real dilemma resulting from their application in developing countries. The latter faces enormous institutional challenges in implementing intellectual property protection, as required by the TRIPS Agreement. Most of them have limited scientific and technological capabilities -little to gain from implementing the obligations of the TRIPS Agreement -. Therefore, its main concernis to reduce the human and resource costs involved in establishing intellectual property protection systems. The most technologically advanced developing countries will need to ensure that their intellectual property systems complement and rein force their broad policies of encouraging technological development and innovation.
