مراحل تطور النظام القانوني للوظيفة العمومية في الجزائر

Résumé: لقد مر قانون الوظيفة العمومية في الجزائر بعدة مراحل بداية من الحقبة الاستعمارية ، أي المرحلـة الـتي سبقت ظهـور أول تشريع جزائري ينظم الوظيفـة العمومية في الجزائر، إضافة للمرحلة الثانية في ظل الأمـر 66- 133 المتضمن القانون الأساسي العام للوظيفة العمومية، ثـم نـعـرج على القانون الصادر في 1978، أي مرحلة توحيد الإطار القانوني العام للشغل (1978- 1990) ومرحلة إعادة تنظيم الوظيفة العمومية (1990-2006) ونختم بالمرحلة التي استقر فيها قانون الوظيفة العمومية ومحاولة الاصلاح الإداري سنة 2006 وفق الأمر 06/03. وتهدف هذه الدراسة إلى معرفة النظام القانوني للوظيفة العمومية والتعديلات المختلفة التي مست هذا القانون في ظل الظروف الاقتصادية والسياسية التي عرفتها البلاد. وتكمن أهمية الموضوع في معرفة الخلفيات التاريخية والسياسية والاقتصادية التي أدت الى تعديل قانون الوظيفة العمومية، وما يمكن قوله أيضا أن هذه التعديلات لا تكفي كون أن هذا القانون لم يعرف أي تعديل منذ 2006، اضافة إلى التطورات التي عرفتها البلاد في مختلف المجالات، الأمر الذي يحتم على المشرع الجزائري إحداث تعديل في هذا القانون. , the law of public service went through different a phase, that’s to say the phase before the emergence of the first Algerian legislation concerning public service. In addition to the second phase of the article of 66-133 concerned with the fundamental law for public service, then the law issued in 1978, meaning the phase of the general legal framework of employment (1978 – 1990) and the phase of organizing public service (1990 – 2006), finally the phase of stability of the law of public service and the attempts of administrative reform in 2006 according to article 06/03. This study aimed to highlight aspects of the general law concerning public service and the modifications in this regard during different political and economic circumstances known to the country. On the other hands, the importance of this study is to understand the historical, political and economic backgrounds that led to the modification of public service law, all that can be highlighted is that this modifications aren’t enough because this law has never been modified since 2006, in addition to the developments in various field which resulted in the obligation of modifying this law.
