الحماية القانونية للحيوانات البرية المهددة بالانقراض في المجالات المحمية على ضوء التشريع الجزائري

Résumé: تمثل الثروة الحيوانية إرثا طبيعيا لا يستهان به بالنظر لقيمتها البيئية و العلمية و حتى الاقتصادية و على الرغم من كل هذا إلا أن الواقع الراهن المبني على الأبحاث و الدراسات يكشف أن هذه الكائنات في تناقص مستمر يصل لحد الانقراض نتيجة لأنشطة الإنسان المتزايدة ، لذا وجب إخضاعها لنظام قانوني حمائي يكفل لها البقاء و الاستمرارية ضمن بيئتها الطبيعية الأمر الذي كرسه المشرع الجزائري باعتماده عدة آليات قانونية، أهمها المجالات المحمية التي نظمها بموجب القانون 11-02 المؤرخ في 17 فيفري 2011 المتعلق بالمجالات المحمية في إطار التنمية المستدامة و الذي يلعب دور هام في حماية الحيوانات المهددة بالانقراض من خلال الحظر المطلق لبعض الأنشطة البشرية و إقرار نظام التراخيص المسبقة للقيام ببعض الأنشطة المباحة كآلية وقائية من ناحية و فرض عقوبات جزائية على المخالفين كآلية ردعية من ناحية أخرى Livestock is a significant natural resource given its environmental and scientific and even economic value.Despite all this the current reality is based on reserch and studies reveals that these animals are in constant decline to the point of extinction as a result of human activities increased so it's must be subject to a legal system protect These animals to ensure survival and continuity in its natural envermantal Which was enshrined by the Algerian legislator by adopting several mechanism the most important areas protected by law number 11/02 dated 17february2011 concerning protected areas within the frame work of sustainable development which play an important role in protection of endangered animals through the absolute prohibition of some Human activities and Adoption of the system of prior licenses to carry out some permissible activities as a corollary on the one hand and imposition of penalities for offenders as a deterrent on the other hand
