جريمة الاتجار بالبشر في القانون اليمني

Résumé: ملخص البحث تتكون جريمة الاتجار بالبشر من عدة أفعال يعد كل فعل منها جريمة بحد ذاته، وتتم هذه الأفعال باستخدام الجاني وسائل تُعيب إرادة المجني عليه، ليتمكن من استغلاله، بارتكاب صورة أو أكثر من صور الاستغلال التي جرمها قانون مكافحة الاتجار بالبشر. ولقد أخذ القانون اليمني نصوصه من برتوكول منع وقمع ومعاقبة الاتجار بالأشخاص المكمل لاتفاقية الأمم المتحدة بخصوص جريمة الاتجار بالبشر، ومن القانون الاسترشادي العربي لمكافحة الاتجار بالبشر، مع الاحتفاظ بخصوصية السياسة العقابية اليمنية. وتتكون جريمة الاتجار بالبشر من ركن مادي وركن معنوي، أما الركن المادي فيتمثل في قيام الجاني بفعل من أفعال جريمة الاتجار بالبشر، واستخدام وسائل غير مشروعة، بقصد استغلال الضحية بصورة من صور الاستغلال المجرمة. أما الركن المعنوي فيتمثل في علم الجاني بأنه يقوم بإرتكاب فعل من أفعال جريمة الاتجار بالبشر، وهو بكامل إرادته. الكلمات المفتاحية: الاتجار بالبشر- الضحية -العقوبة. Abstract The crime of human trafficking consists of several acts, each of which is a crime in itself, and these acts are carried out by the offender using which leads to exploiting and disgracing the will of the victim thus committing one or more forms of exploitation criminalized by the Anti-Human Trafficking Law. Yemeni law has taken its texts from the Protocol to Prevent, Suppress and Punish Trafficking in Persons supplementing the United Nations Convention on the Crime of Human Trafficking, and from the Arab Guiding Law to Combat Human Trafficking, while preserving the privacy of the Yemeni punitive policy. The crime of human trafficking consists of a material element and a moral element, the material element is represented in the offender's act of the crime of human trafficking, and the use of illegal means, with the intent of exploiting the victim in a form of criminal exploitation. As for the moral element, it is represented in the offender’s knowledge that he is committing an act of the crime of trafficking in human beings, which is of his own free will.
