المحكمة الجنائية الدولية ومتطلبات إحترام مبدئي الشرعية والسيادة

Résumé: يتناول هذا المقال،القيود الإجرائية التي يجب على المحكمة الجنائية الدولية إحترامها على غرار مبدئي الشرعية والسيادة،وهو موضوع في الحقيقة يهدف إلى إبراز مدى أخذ النظام الأساسي بمبدأ الشرعية على النحو الصحيح المتعارف عليه في القوانين الداخلية،اَخذا بعين الإعتبار خصوصية القانون الدولي الجنائي،وإلى تقييم نصوص النظام الأساسي فيما يتعلق بمدى إحترامها لسيادة الدول،لنخلص إلى ضرورة تعديل النظام الأساسي بما يؤدي إلى تطبيق مبدأ الشرعية تطبيقا صحيحا و إلى إزالة العوائق التي تهدد مبدأ التكامل. Abstract: This article tackles the procedural restrictions, the ICC must respect similar to the principles of legality,and sovereignty, and it’s in reality a topic aims to highlight the extent to which the fundamental system takes correctly the legality principle is common in internal rules taking into consideration the specificity of the international criminal law. and to an assessment of fundamental system which concerns it’s respect for the states sovereignty.To recapitulate, lastly to the necessity of amending the fundamental system which leads to the application of the legality principle appropriately, and to the elimination of obstacles that threaten the principle of complementarity.
