التأليف في مقاصد الشريعة والدعوة إلى استقلالها عن أصول الفقه

Résumé: يدرس هذا المقال مسيرة التأليف في مقاصد الشريعة في كتابات الأصوليين منذ القرون الأولى عند بداية التدوين، والّتي كانت فيه مقاصد الشريعة ضمن مباحث الأصول، واستمرّ الأمر هكذا إلى أن جاء العزّ بن عبد السلام والشّاطبي اللّذين أعطيا لها نوعا من التباين دون الاستقلال التامّ كمرحلة ثانية في تدوين مقاصد الشريعة، وهكذا إلى أن جاء الطّاهر بن عاشور الّذي ألّف كتابا مستقلا في المقاصد سمّاه (مقاصد الشريعة الإسلامية)، والّذي دعا فيه إلى استقلال مقاصد الشريعة عن أصول الفقه؛ لتكون علما مستقلا بذاته، وهكذا توالت التأليفات في المقاصد بعد ابن عاشور تأليفا مستقلا عن أصول الفقه، ليكون بذلك قد أسّس لمرحلة جديدة في التأليف المقاصدي. This article examines the process of authorship in the purposes of the Sharia in the writings of fundamentalists since the first centuries at the beginning of blogging, in which the purposes of the Sharia were part of the investigation of the fundamentalist lesson. This continued until Al-Izzz ibn Abd al-Salam and Al-Shatabi, who gave to it a kind of disparity without complete independence, came as a second stage in the codification of the purposes of the Sharia, and so came Tahir Ibn Ashour, who wrote an independent book in the purposes called it (the purposes of the Islamic law), In which he called for the independence of the purposes of the Sharia from the principles of jurisprudence; To be an independent science in itself, and thus the authorship in the purposes after the son of Ashour was a separate authorship from the origins of jurisprudence, so that it was thus established for a new stage in the authorship purposes.
