التعارض والاختلاف في النظر إلى طبيعة الحق ومصدره بين التشريع الإسلامي والقانون الوضعي Conflict And Divergence In Looking At Nature Of The Right And Its Source Between Islamic Legislation And Positive Law

Résumé: مـلـخـص إن تحديد مفهوم الحق وطبيعته في الفقه الإسلامي المستمد من الكتاب والسنة، يختلف عنه في الأنظمة القانونية الوضعية؛ لأن الإنسان في نظر التشريع الإسلامي مكلفا ملزما بعبودية الله أكثر من كونه صاحب حق، فالتكليف هو أساس الشريعة، ومن ثم لا يوجد حق شرعي من غير دليل عليه، فضلا عن أن الحق في الفقه الإسلامي يتصف أيضا بالثبات والازدواجية. أما تصور الحق في الأنظمة القانونية الوضعية، على العكس من التصور السابق، يتصف بعدم الثبات والتغير المستمر، لكونه يخضع لإرادة و اجتهاد الإنسان تحت تأثير عوامل ودوافع اقتصادية واجتماعية و سياسية وثقافية. وهذا ما يتجلى من التطور التاريخي الذي عرفه تصور الحق في الأنظمة القانونية بداية من المذهب الفردي،.ثم المذهب الاجتماعي. وأخيرا ما يعرف بمذهب نسبية الحقوق. Abstract The definition of the concept of law and its nature in Islamic doctrine derived from the Quran and Sunnah is different from the legal systems. The right in Islamic doctrine is characterized by stability and duality: The perception of the law in the legal systems, as opposed to the previous conception, is characterized by constant instability and change, because it is subject to the will of the human being under the economic, social, political and cultural influence. And this is reflected in the historical development of the conception of law in legal systems beginning with individualism, Then came socialism, which considers rights as social functions ,finally came what is called the doctrine of the relativity of rights.
