ولاية الاب في تزويج البنت شرعا و قانونا

Résumé: ملخص ; قبل تعديل قانون الأسرة لسنة 2005 كان يتولى زواج المرأة وليها وهو أبوها. لكن بعد تعديله وبموجب المادة 11 منه أصبحت المرأة الراشدة تعقد زواجها بنفسها و بحضور أبيها على اعتبار أن دور الاب أصبح شكليا . بحيث يحق لها أن تختار أحد من أقاربها أو أي شخص تختاره ليحضر زواجها اذ لم يحضر بنفسه .لكن من الناحية العملية رغم أن ضابط الحالة المدنية لم يجد صعوبات في تطبيق هذه المادة فالمراة لاتزال تحافظ على مكانة والدها الاجتماعية في عقد زواجها وهذا حفاظا على مصلحتها و صيانة كرامتها من أي مساس بها abstract ; Before the amendment of the family law of 2005 was the marriage of the woman take over by her guardian means her father but after his modification according to the article 11.adult woman has her marriage in the presence of her father. Considering that the role of the father became formality so that she has the right to choose one of her relatives or any person to attend her marriage if her father did not attend .but in practice although the civil status officer did not find it difficult to apply this article .the woman still maintains the status of her father in the social when she do marriage contact.
